These Terms of Service ("Terms") govern your use of the websites, games and mobile applications (the "Service") operated by NForge Game Studio ("NForge", "us", "we", or "our"), including FinnyTopia Tycoon. By installing, accessing or playing our games, or by using our website, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your country of residence, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. By using the Service, you represent that you meet these requirements.
2. License and Restrictions
We grant you a personal, non-transferable, non-exclusive, revocable, limited license to install and play our games and to use the Service for non-commercial entertainment purposes only, subject to these Terms. You agree that you will not, and will not attempt to:
- Copy, modify, adapt, translate, distribute, sell, rent, lease or sublicense any part of the Service;
- Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the Service, except to the extent permitted by applicable law;
- Use cheats, bots, automation software, hacks, mods, exploits or any unauthorized third-party software designed to modify or interfere with the Service;
- Interfere with, disrupt or create an undue burden on the Service, its servers or networks;
- Bypass or circumvent any technical measures we use to provide or protect the Service;
- Use the Service for any commercial purpose without our prior written consent, including farming, selling accounts, or selling virtual items for real money;
- Use the Service in violation of any applicable law or regulation.
3. Accounts and Access
Some features of the Service require you to sign in with a third-party account (such as Google or Google Play Games). You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. We reserve the right to suspend or refuse access to the Service, or to any part of it, at any time, where we reasonably believe these Terms have been violated. We do not guarantee that the Service will be available at all times, in all locations, or on all devices.
4. Virtual Items and Virtual Currency
The Service may include virtual currency (such as coins or diamonds) and virtual items (such as fish, decorations, buildings or boosts). You acknowledge and agree that:
- Virtual items and currency are licensed to you, not sold; you receive a limited, revocable license to use them within the Service;
- They have no real-world monetary value, are non-refundable (except where required by applicable law), and cannot be exchanged for cash, goods or services outside the Service;
- They cannot be transferred or resold to any other person;
- We may modify, rebalance, add or remove virtual items and currency at any time as part of operating and improving the games;
- Upon termination of your account or discontinuation of a game, any virtual items and currency associated with your account will be forfeited without compensation, except where applicable law requires otherwise.
5. In-App Purchases
Purchases are processed by the platform through which you use the game (Google Play or the Apple App Store) and are governed by that platform’s terms and refund policies. We do not process or store your payment details. All purchases are final unless otherwise required by applicable law or by the platform’s refund policy. Prices may change at any time; changes do not affect purchases already completed.
6. Advertising
The Service may display advertisements, including rewarded and interstitial ads served by Google AdMob. The frequency and placement of ads may change at any time. Ad content is provided by third parties and is governed by the respective advertisers’ and Google’s policies; we are not responsible for the content of third-party advertisements. Information about how advertising data is handled is set out in our Privacy Policy.
7. Game Progress, Updates and Roll-Backs
We are continuously developing the Service. You acknowledge and agree that:
- We may update, patch, rebalance or change the games at any time, including gameplay mechanics, content, virtual items and progression;
- Updates may be required for continued play;
- In the event of bugs, exploits, data corruption or fraudulent activity, we may roll back game progress, remove improperly obtained items or currency, or restore the game state to an earlier point;
- We may modify, suspend or discontinue any game or feature, in whole or in part, at any time. Where reasonably possible, we will give advance notice of the permanent shutdown of a game.
8. User Conduct
You agree to behave respectfully toward other players and toward our team, and not to engage in any conduct that is unlawful, abusive, harassing, fraudulent or harmful to the Service or its users. Where the Service allows you to submit content (such as a profile name or feedback), you must not submit content that is offensive, infringing, deceptive or unlawful, and you grant us a non-exclusive, worldwide, royalty-free license to use such content for the purpose of operating and promoting the Service.
9. Intellectual Property
The Service and all of its content — including games, code, graphics, artwork, characters, names, logos, music, sounds, text and design — are owned by or licensed to NForge and are protected by copyright, trademark and other intellectual property laws. Except for the limited license expressly granted in these Terms, no rights, title or interest in the Service are transferred to you. "N-Forge", the N-Forge logo and our game titles are trademarks of NForge Game Studio.
10. Third-Party Products, Services and Links
The Service operates on and integrates with third-party platforms and services (such as Google Play, the Apple App Store, Google Play Games and Firebase) and may contain links to third-party websites. Your use of those platforms and services is governed by their own terms and policies. We are not responsible for third-party services, and a link does not imply endorsement.
11. Termination
We may suspend or terminate your access to the Service, without prior notice, if you violate these Terms, engage in fraudulent or abusive behavior, or where required by law. You may stop using the Service at any time and may request deletion of your account data as described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Sections 9, 12, 13 and 14) shall survive.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US THROUGH THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR, IF YOU HAVE MADE NO SUCH PAYMENTS, FIFTY (50) EUROS. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
14. Indemnification
You agree to indemnify and hold harmless NForge and its owners, employees and partners from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last Modified" date at the top. For material changes, we will provide reasonable notice within the Service where practicable. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul, Türkiye, except where mandatory consumer protection law grants you the right to bring proceedings in your country of residence.
17. General
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and NForge regarding the Service.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- No waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- No assignment: You may not assign or transfer these Terms or your account. We may assign these Terms in connection with a merger, acquisition or sale of assets.
